Dear Sir or Madam,

The undersigned non governmental organizations and individuals,devoted to the protection of human rights in Mexico, wish to respectfully request that you urgently consider the following information:

The Supreme Court of Mexico announced that it adopted a decision whereby the practice of arraigo may not be declared contrary to international human rights treaties to which Mexico is a party, since the restriction to liberty, regardless of its arbitrariness, is contained in the constitution.

The justices (ministros) of the Supreme Court made repeated reference to the need to “protect” the institution of arraigo against norms contained in international treaties which could be construed not to allow such practice.  Please find attached to this letter extracts of some of such statements (together with a free translation into English for your convenience).

We respectfully submit that the decision of the Supreme Court of Mexico is, in itself, contrary to your recommendations, or at least, an important obstacle to eradicate the practice of arraigo from the judicial practice, as you rightfully recommended to Mexico.

The Supreme Court has not yet made public the final text of the decision (engrose), so, we consider possible that the Supreme Court
could adjust the language in order to harmonize it to Mexico’s international obligations to adopt judicial measures that are more conductive to the protection of human rights, and not “regressive” measures, which constitute a breach of international human rights law.

The supreme Court, for instance, could clarify in the final text of the decision, that the restrictions or limitations of human rights contained in the Mexican constitution shall prevail so long as they comply with international standards, that is, that such restrictions or limitations are prescribed by law and are necessary to protect public safety, order, health, or the fundamental rights and freedoms of others, and not only because they are contained in the constitution.  Under such viewpoint, would the constitutional re-establishment of the death penalty not be contrary to international law (particularly the Second Protocol of the International Covent of Civil and Political Rights, to which Mexico is a party), only because such “restriction” would be contained in the constitution?

We would respectfully beg you to send a communication to Mexico, requesting corroboration of the information contained herein, namely (i) whether the decision adopted on 3 September 2013 by the Supreme Court of Mexico would prevent Mexican courts to declare that the practice of arraigo is contrary to international treaties to which Mexico is a party, and therefore (ii) whether such situation would prevent your recommendations to eliminate arraigo detention from judicial practice be complied with, and (iii) whether measures will be taken by the Supreme Court in order to avert such negative effect.
